4. On February 23, 1944, the Department of Revenue, Income Tax Section, of the State of Colorado, gave notice to the plaintiff of a deficiency assessment with regard to its Income Tax for the taxable year ending December 31, 1939, in the amount of $1,839.77, plus interest from April 15, 1940, in the sum of $432.35. A copy of said Notice of Assessment together with a copy of Explanation of Income Tax Deficiency are attached hereto, incorporated herein by reference and marked Exhibit A.
This is practically a companion case to Wolf v. People, 117 Colo. 279 187 P.2d 926, decided by this court November 3, 1947, in that the principal question there considered is the principal one here. That case was tried December 4, 1944 before district judge Black and this, February 25, 1945 before district judge Cook. Wolf is a plaintiff in error in each and the Fultons stand in this case in the position of Montgomery in the other. Save for Mr. Zarlengo, who did not appear in Wolf v. People, supra, counsel in the cases were the same and they were argued together here. Exhibits A and C in the former case are Exhibits D and E here.
An action by defendants in error, plaintiffs below, against plaintiff in error, defendant, to quiet title to lands described in the complaint, two lots and a residence in Boulder. Plaintiffs claimed under a conveyance solely from the wife of defendant. Defendant claims under a statutory homestead entry which he had made prior to such conveyance, of which plaintiffs had both constructive and actual notice. Plaintiffs enjoyed favorable judgment.
In this case a two-count information was filed, charging Frank J. Byrnes with misrepresentations to effect sales, and conspiracy to make misrepresentations to effect sales of certain merchandise and service."
